§ 1 – Provider, inclusion of the GTC

(1) The provider and contractual partner for the goods presented in the VERTICS Shop is: VERTICS Steffen Hummel, Waldstr. 17a, 65187 Wiesbaden (hereinafter referred to as the “Provider”).

(2) These general terms and conditions are an integral part of every contractual agreement between the provider and the respective customer. Conflicting terms and conditions of the customer are contradicted.

§ 2 – Offer of goods and conclusion of contract

(1) The provider offers the items presented in its online shop for sale. The colour of the articles on the website may vary slightly depending on the internet browser used and the monitor settings of the customer; these deviations are never completely avoidable from a technical point of view.

(2) The selection of goods, the conclusion of the contract and the execution of the contract shall be carried out in German.

(3) The provider sells to customers within Germany, within Europe and worldwide. Import sales tax and customs duties may apply.

(4) The customer selects the desired goods by placing them in the “shopping cart” or by clicking on the “Go directly to checkout” button. The order request can then be transmitted to the provider via the button “order with obligation to pay”. The customer has the option of viewing and changing the data provided in the context of the order or canceling the order altogether at any time until the order has been sent.

(5) For the goods presented in the Provider’s shop, the Provider submits a binding purchase offer. By sending the order request via the button “order with obligation to pay”, the customer accepts the purchase offer. The Provider confirms the conclusion of the contract by e-mail (contract confirmation).

(6) The content of concluded contracts is stored in the VERTICS Shop user account of the customer and can be viewed by the customer at any time via the menu “My orders” under the item “My purchases”.

(7) In the event of delivery obstacles or other circumstances that would prevent the fulfilment of the contract, the Provider shall inform the Purchaser by e-mail. A partial delivery will only take place with the consent of the customer.

§ 3 – Prices and Payment

(1) All product prices are final prices plus shipping costs. The fees include 19% VAT.

(2) The shipping costs are listed in the respective product description under the menu item “Payment Shipping”.

(3) The Provider delivers at the customer’s discretion against advance payment, against advance payment by bank transfer or against advance payment by PayPal payment. With the contract confirmation (§ 2 para. 5), the customer will receive an Internet link by e-mail that leads him to the VERTICS shop “My Purchases”, which contains further information on the purchase process.

a) For payment by voucher, the customer can enter one or more voucher codes in the “My Purchases” area. The voucher value will be credited to the provider and the invoice amount will be paid in this way. If a voucher value is higher than the invoice amount, the voucher remains valid in the amount exceeding it.

b) If the customer has chosen “bank transfer” as the payment method, the customer will be informed of the provider’s bank details in the “My purchases” area. The provider accepts transfers from abroad as free payments in euros or in the respective national currency at the applicable exchange rate.

c) If the customer has chosen “PayPal” as the payment method, he will be taken to the PayPal online service via the button “Click here to pay with PayPal” and can initiate payment there.

(4) For prepayment orders, a payment period of one week from receipt of the contract confirmation applies. The Provider shall return the desired goods for the Purchaser during the period of payment. It is the customer’s responsibility to effect his payment in time so that it is received by the provider within the deadline. The Supplier reserves the right to withdraw from the purchase contract and sell the goods elsewhere if payment has not been received by the deadline. Any payment received by the customer after withdrawal will be refunded to the customer.

§ 4 – Dispatch, delivery times

(1) The provider shall hand over the goods to be delivered to the shipping company within five working days of receipt of payment in full.

(2) The shipping company needs approx. 2 working days from the time of delivery by the provider, unless otherwise stated in the article description.

(3) If the delivery to the customer fails because the customer has provided the delivery address incorrectly or incompletely, a new delivery attempt will only take place if the customer assumes the costs for the reshipment. The new shipping costs correspond to the shipping costs agreed upon at the conclusion of the contract. The Provider will inform the Purchaser of the necessary costs of redelivery by e-mail. A new shipment will only take place after receipt of payment of these costs.

§ 5 – Return of goods as a consumer

(1) Purchasers who purchase as consumers (§ 13 BGB) are entitled to a right of withdrawal in accordance with the legal requirements (§§ 312d, 355 BGB). Details on this can be found in the cancellation policy.

(2) If the Purchaser is a consumer, the parties to the purchase contract agree in the event that the right of revocation is exercised that the Purchaser shall bear the regular costs of the return shipment if the goods delivered correspond to those ordered and if the price of the goods to be returned does not exceed an amount of 40 euros or if, in the event of a higher price of the goods, the Purchaser has not yet paid the consideration or a contractually agreed partial payment.

(3) Insofar as the Purchaser has to bear the return costs, the amount of money to be reimbursed by the Provider and the return costs to be reimbursed by the Purchaser may be offset against each other.

§ 6 – Warranty

The warranty rights of the customer are based on the statutory provisions.

§ 7 – Final provisions

(1) The Provider collects and processes the data entered by the Purchaser in the course of its purchase for the purpose of processing and fulfilling the contract. If the customer uses the PayPal service to pay for his purchase, the PayPal privacy policy applies to the payment process. PayPal acts as a vicarious agent of the customer, not of the provider.

(2) Should individual provisions of these General Terms and Conditions prove to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
